  • Fintesk will only use access to read, write, modify, or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read, and process emails and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.
  • Fintesk will not use this Gmail data to serve advertisements.
  • Fintesk will not allow others to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, complying with applicable law, or for Fintesk's internal operations and even then only when the data has been aggregated and anonymized.

Fintesk's use of information received and Fintesk's transfer of information to any other app from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

5. To Whom We Disclose Information

Except as described in this Privacy Notice, we will not intentionally disclose Personal Data or Client Data we collect or store on the Service to third parties without the consent of the applicable Visitor, User, or Client. We may disclose information to third parties if you give us your consent to do so, as well as in the following circumstances:

5.3 Service Providers

We work with third-party service providers who provide us with website, application development, hosting, maintenance, security, and fraud detection services, among others. These third parties may have access to or process Personal Data or Client Data as part of providing those services to us. We limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and our contracts with them require them to maintain the confidentiality of such information.

5.4 Fintesk Communities and Other User-Generated Content

We make various community forums and self-help support materials available to you, as well as blogs and other means for you to post information on our websites. This information you post is publicly available information that you choose to disclose and may be read, collected, and processed by others visiting these websites. Except for your username (which may be your real name) and details you choose to include in your profile, the categories of data disclosed in these circumstances will depend on the information you choose to provide. Your posts and certain profile information may remain even after you cancel your Fintesk account given that they are not directly related to the service. Fintesk websites may use social media features, such as the Facebook “Like” button, LinkedIn and Twitter sharing features, and other similar widgets (“Social Media Features”). Such Social Media Features may give you the option to post information about your activities on a website to a profile page of yours provided by a third-party social network to share content with others within your network. Social Media Features are hosted on the respective social network or directly on our websites. To the extent the Social Media Features are hosted on the respective social networks and you click on them from our website, the latter may receive information showing that you have visited our website. If you are logged into your social media account, it is possible that the respective social network can link your visit to our websites with your social media profile. Your interactions with Social Media Features are governed by the privacy policies (and any other applicable terms) of the respective companies providing the relevant Social Media Features.

5.6 Advertising and Marketing

We partner with third-party ad networks to display advertising on our website or to manage our advertising on other sites. Our ad network partner uses cookies to collect information about your activities on this and other websites to provide you with targeted advertising based on your interests. If you do not wish for this information to be used for the purpose of serving you targeted ads, you may opt-out of using these services: networkadvertising or aboutads (or if located in the European Union, by clicking here: youronlinechoices). Please note that this does not prevent you from receiving advertising; you will continue to receive generic ads.

5.7 Business Partners

We may share data with trusted Fintesk partners to contact you based on your request to receive such communications, help us perform statistical analysis, provide sales support, or provide customer support. Partners are prohibited from using your Personal Data except for these purposes, and they are required to maintain the confidentiality of your data. We partner with trusted third parties to provide content that we think may be relevant to you. When you engage with these partners, we will tell you who we share data with and provide a link to the partner's privacy policy so you can know how to opt-out of the partner's communications. These partners must comply with our privacy and data protection policies. For more information about our partner program, please see this page. If you do not want us to share your personal data with these companies, please contact our partner team at partners@fintesk.com.

We may disclose Personal Data or other information if required to do so by law or if we have a good faith belief that such action is necessary to comply with applicable laws, in response to a facially valid court order, judicial or other government subpoena, or to otherwise cooperate with law enforcement or other government agencies. We also reserve the right to disclose Personal Data or other information that we believe, in good faith, is appropriate or necessary to (i) take precautions against potential risks, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activities, (iii) investigate and defend ourselves against third-party claims or allegations, (iv) protect the security or integrity of the Service and any facilities or equipment used to make the Service available, or (v) protect our property and rights or other legal rights, enforce our contracts, or the property or safety of others.

5.10 Change of Ownership

Information about Users and Visitors, including Personal Data, may be disclosed and otherwise transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets and only if the recipient of the User or Visitor Data commits to a Privacy Policy that has terms substantially consistent with this Privacy Notice.

Client Data may be physically or electronically transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets, for the sole purpose of continuing the operation of the Service, and only if the recipient of the Client Data commits to a Privacy Policy that has terms substantially consistent with this Privacy Notice.

6. Data Security

At Fintesk, we take data security very seriously. We have taken steps to implement appropriate administrative, technical, and physical security measures to prevent unauthorized access, use, modification, disclosure, or destruction of the information you entrust to us. Fintesk is committed to maintaining a high level of security, aligned with international standards such as ISO/IEC 27001 to ensure the confidentiality, integrity, availability, and resilience of Personal Data.

However, no security system is perfect, and due to the inherent nature of the Internet, we cannot guarantee that data, including Personal Data, is absolutely safe from intrusion or other unauthorized access by third parties.

You are responsible for protecting your password(s) and other authentication factors, as well as maintaining the security of your devices. If you believe your Personal Data has been compromised, please contact us as set forth in the “How to Contact Us” section. If we learn of a breach of security systems, we will inform you and the authorities of the occurrence of the breach in accordance with applicable law.

7. International Data Transfers

Fintesk may transfer your Personal Data to countries other than the one in which you live, including transfers to the United States or Ireland. To the extent Personal Data is transferred abroad, Fintesk will ensure compliance with applicable law requirements in the respective jurisdiction in accordance with Fintesk's obligations. If the transfer is made to a country that does not have an adequacy decision from the Chilean Agency, Fintesk will ensure appropriate safeguards are applied, such as signing Standard Contractual Clauses (SCCs) or equivalent certification mechanisms.

In particular, we offer the following guarantees if Fintesk transfers Personal Data from jurisdictions with different data protection laws:

Standard Contractual Clauses of the European Commission. Fintesk uses Standard Contractual Clauses approved by the European Commission (and equivalent Standard Contractual Clauses for the United Kingdom where applicable) for transfers to countries not subject to an adequacy decision by the European Commission or its local legislature or regulator.

8. Privacy of Minors and Children

Protecting the privacy of young children is extremely important. Our Service is not directed to or intended for children under 18 years of age, and we do not knowingly collect Personal Data from children under 18 years of age.
